This Privacy Policy aims to inform you about how we (K MIKIMOTO & Co Ltd) use and manage your personal data collected and/or processed.

ARTICLE 4. COLLECTION & ORIGIN OF DATA

All data concerning you is collected directly from you, during your contact requests, during your purchases, during your connections, during your subscription to our newsletter and our various exchanges (online requests, letters, phone calls, satisfaction surveys ...).

In addition, data relating to your browsing on our website may also be used to measure the audience of our site and thus improve our services.

ARTICLE 5. PURPOSES & LEGAL BASIS OF THE PROCESSING OPERATIONS

Your data is collected and processed for :

Legal basis: our legitimate interest in communicating to you information and commercial offers for our products similar to those for which you are already customers with us and inviting you to our events and parties and your consent when required by the regulations in force.

    This covers the management of the exercise of your rights of access, rectification, deletion or portability of your data or of opposition or request for limitation of the processing of your data, or of defining the fate of your data.

The data likely to be processed are the following:

  • Data relating to your identity: civility, surname, first names, nationality, passport and/or identity card number, date of birth, address, country of residence, telephone number, email address.
  • Data relating to purchases: history, date, sales slip number, amount, details and characteristics of the product purchased, type of payment method.
For the management of our commercial relationship and customer follow-up

  • Data relating to the organisation and processing of competitions, lotteries and any promotional operation such as the date of participation, the answers given to the competitions and the nature of the prizes offered.

For the management of your requests to exercise rights on your personal data The data likely to be processed are the following: civility, surname, first name, email address, the subject and text of your request, our reply, possibly a copy of your ID, when necessary.

ARTICLE 7. RECIPIENTS OF YOUR DATA

Your data will not be sold or rented to third parties. Only our authorized personnel are likely to have access to your data.

Other persons may have access to your data in a more limited way: the authorized persons of our editors of accounting management software, our accountants, the authorized services of our parent company K MIKIMOTO & Co LTD, our DPO and exceptionally, the courts and officers of justice and law enforcement if necessary, particularly in the context of litigation or judicial investigations.

ARTICLE 8. TRANSFER OF DATA OUTSIDE THE EUROPEAN UNION

Data transfers can take place to our parent company K. MIKIMOTO & Co LTD located in Japan, 5-5-4 Chome Ginza Chuo Ku Tokyo, recognized by the European Commission as a country offering an adequate level of protection for your data.

ARTICLE 9. DATA RETENTION PERIOD

We keep your data only as long as necessary for the purposes described in Article 5 and summarized in the table below.

For the management and the follow-up of your purchases, deliveries, invoices, tax exemptions and the management of our customer relationship and customer follow-up.

Your data is kept for the duration necessary for the execution of the contract and the management of our business relationship.

These data are then archived for a period of 5 years for evidentiary purposes. Your invoices and accounting data are kept for 10 years.

3 months for the tax refund management file.
For commercial prospecting 3 years from the end of the commercial relationship if you are a customer or from your last contact if you are not yet a customer (then archived for 5 years for probationary purposes).
For the management of your identity documents as part of the management of the exercise of your rights

Your identity card: 1 year in case of exercise of the right of access and rectification.

Your identity card: 3 years if you exercise the right of opposition.

ARTICLE 10. YOUR RIGHTS

In accordance with the Data Protection Act and the RGPD, you have the following rights:

  • Right of access (article 15 RGPD), of rectification (article 16 RGPD), of update, of completeness of your data (more information).
  • Right to block or erase your personal data (article 17 RGPD), when they are inaccurate, incomplete, ambiguous, outdated, or whose collection, use, communication or storage is prohibited (more information).

  • Right to the portability of the data you have provided us with, when your data are subject to automated processing based on your consent or on a contract (article 20 RGPD).
  • Right to determine the fate of your data after your death and to choose whether or not we disclose your data to a third party you have previously designated (read more).

In the event of your death and in the absence of instructions from you, we undertake to destroy your data, except if their retention is necessary for evidentiary purposes or to meet a legal obligation.
